The terms “we,” “us,” and “our” refer to Dunning Beauty Works. Dunning Beauty Works operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience collectively referred to as the “Services.”

Dunning Beauty Works is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them, are collectively referred to as these “Terms of Service” or “Terms.” They describe your rights and responsibilities when you access or use the Services.

We do not guarantee that the appearance, color, packaging, or perceived quality of a product will be identical to photographs or other representations displayed through the Services.

Product packaging, labels, instructions, ingredient lists, and formulations may occasionally be updated by manufacturers or suppliers. Customers should review the information printed on the product packaging before use, particularly when allergies, sensitivities, or ingredient restrictions are a concern.

Product descriptions, prices, availability, and other information may be changed at any time without notice.

We reserve the right to discontinue a product or limit the quantities available to any person, household, geographic area, or jurisdiction on a case-by-case basis.

When you place an order, you are making an offer to purchase the products in your order.

Dunning Beauty Works reserves the right to accept, reject, limit, or cancel an order for a lawful reason and at our reasonable discretion. An order is not accepted until we confirm acceptance and successfully process the applicable payment.

Please review your order carefully before submitting it. We may be unable to change or cancel an order after processing or fulfillment has begun.

If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing information, shipping information, or phone number provided with the order.

We may limit or cancel quantities that appear to have been placed by resellers, distributors, automated purchasing systems, or other parties purchasing for commercial resale.

Purchases are subject to our Return and Refund Policy and Shipping Policy.

You represent that purchases made through the Services are for lawful personal or household use and not for unauthorized commercial resale, export, or distribution.

SECTION 4 – PRICES, PAYMENTS, AND BILLING

Prices, discounts, promotions, and product availability may change without notice.

The price charged for a product will generally be the price displayed when the order is submitted, subject to correction of errors and confirmation in your order documentation.

Unless otherwise stated, displayed prices do not include applicable taxes, shipping charges, customs charges, duties, or other fees.

Prices offered through our online store may differ from prices displayed by manufacturers, suppliers, marketplaces, physical retailers, or other third-party sellers.

Promotions may be subject to separate eligibility requirements, expiration dates, exclusions, or other conditions. If promotion-specific terms conflict with these Terms, the promotion-specific terms will control for that promotion.

You agree to provide accurate and complete purchase, billing, payment, shipping, and account information.

You agree to update your account and contact information when necessary so that we can complete transactions and communicate with you.

You represent and warrant that:

You are authorized to use the payment method provided.
The information provided is true, accurate, and complete.
Charges incurred through your payment method will be honored.
You will pay all applicable charges, including product prices, taxes, and shipping fees.

Payment information is processed through Shopify and applicable payment providers. We do not guarantee that any specific payment method will remain available.

SECTION 5 – SHIPPING AND DELIVERY

Dunning Beauty Works currently ships to eligible addresses within the United States.

Unless a different rate is displayed during checkout, standard shipping is:

$8.99 for qualifying merchandise subtotals below $50
Free for qualifying merchandise subtotals of $50 or more

Product discounts and promotional codes may affect whether an order qualifies for free shipping. The applicable shipping charge will be displayed before the customer completes the purchase.

Orders delivered within the United States are generally expected to arrive approximately 9–14 business days after the order is placed, based on current estimates provided by our fulfillment partner.

Processing and delivery timeframes are estimates and are not guaranteed.

Shipping and delivery may be affected by supplier processing, carrier disruptions, customs or security processing, weather, holidays, high order volumes, address issues, product availability, or other circumstances outside our reasonable control.

Products may be shipped directly by third-party suppliers or fulfillment providers located in a different city, state, or country from Dunning Beauty Works.

Because products may be fulfilled by different suppliers or facilities, an order may be divided into multiple shipments. Packages from the same order may arrive at different times and may have separate tracking information.

Customers will not be charged additional standard shipping solely because an order is divided into multiple shipments.

Customers are responsible for providing complete and accurate shipping information. We may be unable to correct or redirect an order after processing or fulfillment begins.

If we cannot ship an order within the timeframe represented when the order was placed, we will provide the customer with the options required by applicable law. These options may include agreeing to a revised shipping timeframe or canceling the affected unshipped product or order for a prompt refund.

Please contact us promptly if an order is significantly delayed, damaged, lost, or marked as delivered but cannot be located. We will review the matter according to our Shipping Policy, Return and Refund Policy, supplier procedures, carrier requirements, and applicable law.

These Terms permit you to access and use the Services solely for lawful, personal, and noncommercial purposes.

Nothing in these Terms grants you ownership of or a license to any trademark, copyright, patent, trade name, logo, service mark, or other intellectual property belonging to Dunning Beauty Works, Shopify, a manufacturer, supplier, licensor, or another third party.

The Dunning Beauty Works name, branding, logo, designs, and slogans are trademarks or intellectual property of Dunning Beauty Works or its licensors.

Shopify’s name, logo, products, services, designs, and slogans are trademarks or intellectual property of Shopify.

Other trademarks displayed through the Services belong to their respective owners.

SECTION 7 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications, integrations, or services operated by third parties.

We do not necessarily monitor, control, or have input into these third-party tools.

Access to third-party tools may be provided on an “as is” and “as available” basis without representations, warranties, endorsements, or guarantees from Dunning Beauty Works.

Your use of a third-party tool is at your discretion and may be governed by the third party’s terms, policies, and privacy practices.

You should review and understand those terms before using a third-party tool.

We may add new tools, features, integrations, or resources in the future. Unless otherwise stated, those additions will be considered part of the Services and will be subject to these Terms.

We do not control and are not responsible for evaluating the content, accuracy, availability, privacy, security, products, services, or practices of third-party websites.

We are not responsible for harm or damages arising from your use of third-party websites or your purchase or use of third-party products, services, resources, or content.

Before completing a transaction with a third party, review its policies and terms carefully.

Questions, complaints, or claims regarding a third party’s products or services should generally be directed to that third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Dunning Beauty Works is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are made directly from Dunning Beauty Works. Shopify is not the seller of products offered by Dunning Beauty Works.

By using the Services, you acknowledge that Shopify is not responsible for the products sold by Dunning Beauty Works or for injuries, losses, or damages arising from those products or transactions, except to the extent otherwise required by law.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made directly with Dunning Beauty Works.

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Certain personal information may also be processed in accordance with the Shopify Consumer Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services to provide, secure, personalize, and improve Shopify’s platform and the Services.

Information submitted through the Services may be transmitted to and shared with Shopify, service providers, and other third parties that may be located in countries outside the country where you live.

When Shopify Network Intelligence or other Enhanced Services are enabled, Shopify may process information obtained from your interactions with our store, with other merchants, and with Shopify. This processing may support fraud prevention, personalized experiences, product recommendations, advertising, analytics, business insights, and other enhanced services.

Depending on where you live, privacy choices may also be available through our Your Privacy Choices page or the Shopify Privacy Portal.

Shopify currently requires stores using Network Intelligence to inform customers that Shopify processes information from their interactions with the store, other merchants, and Shopify and that information may be shared internationally to provide Enhanced Services.

SECTION 11 – FEEDBACK, REVIEWS, AND OTHER SUBMISSIONS

If you submit, upload, post, email, or otherwise provide ideas, suggestions, reviews, photographs, videos, feedback, proposals, plans, or other content collectively referred to as “Feedback,” you grant Dunning Beauty Works a nonexclusive, worldwide, perpetual, sublicensable, transferable, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, and otherwise use that Feedback in any lawful medium.

This license permits us to operate, provide, evaluate, improve, and promote the Services and our products.

You represent and warrant that:

You own the Feedback or have all necessary rights and permissions to provide it.
You have disclosed any compensation, free products, discounts, or incentives associated with the Feedback when required.
The Feedback is accurate and does not violate these Terms or the rights of another party.

We are not required to:

Keep Feedback confidential.
Compensate you for Feedback.
Publish Feedback.
Maintain Feedback indefinitely.
Respond to Feedback.

We may monitor, moderate, edit, decline to publish, or remove Feedback that we reasonably determine is unlawful, fraudulent, misleading, threatening, abusive, defamatory, obscene, discriminatory, infringing, unrelated, or otherwise objectionable.

Feedback must not violate copyright, trademark, privacy, publicity, personality, or other legal or proprietary rights.

Feedback must not contain malware, malicious code, false information, unlawful content, or misleading claims.

You may not use a false identity, impersonate another person, or misrepresent the origin of Feedback.

You remain responsible for the Feedback you provide.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Information provided through the Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, photographs, ingredients, packaging, pricing, promotions, shipping charges, delivery estimates, availability, or other information.

We reserve the right to correct errors, update information, modify listings, reject an order, or cancel an affected order when information is inaccurate, including after an order has been submitted, subject to applicable law.

When reasonably possible, we may contact the customer before canceling an affected order to explain the issue and any available options.

If we cancel a paid product or order because of an error, unavailability, or inability to fulfill or ship it, we will issue the refund required by applicable law to the original payment method. The refund may include applicable product charges, taxes, and shipping charges associated with the canceled portion.

SECTION 13 – PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services, directly or indirectly:

For an unlawful, fraudulent, deceptive, or malicious purpose.
To violate any international, federal, state, provincial, territorial, or local law or regulation.

Upload or transmit malware, viruses, or malicious code.
Reproduce, scrape, duplicate, extract, sell, resell, or exploit the Services without authorization.
Collect or track another person’s personal information unlawfully.
Phish, pharm, pretext, spam, or engage in similar deceptive practices.
Use automated systems, robots, spiders, scraping tools, data-extraction tools, or artificial-intelligence agents to access the Services in violation of our instructions or applicable law.
Circumvent CAPTCHAs, access restrictions, security measures, robot-exclusion instructions, or authorization controls.

We may restrict, limit, block, or otherwise control whether and how Agents access or interact with the Services.

Agents must:

Identify themselves in applicable requests and disclose the name of the Agent.
Not conceal or misrepresent that activity is being performed by an Agent.
Not mimic human activity for the purpose of bypassing restrictions.
Not complete or circumvent CAPTCHAs or similar protections.
Answer truthfully when asked whether an interaction is being performed by a human or automated system.
Not evade measures designed to block, limit, modify, or control automated access.
Comply with applicable law and these Terms.

SECTION 15 – TERMINATION

We may suspend or terminate your account or access to the Services when reasonably necessary, including when we believe you have violated these Terms, engaged in fraud, threatened the security of the Services, or created legal or operational risk.

You remain responsible for amounts owed for transactions completed before termination.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, dispute terms, privacy, and governing law.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes.

We do not warrant that all information will always be accurate, complete, current, or suitable for every individual or purpose.

WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, REPRESENTATIONS, AND CONDITIONS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUNNING BEAUTY WORKS AND ITS OWNERS, AFFILIATES, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER A CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANOTHER LEGAL THEORY AND REGARDLESS OF WHETHER WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Dunning Beauty Works, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising from:

Your violation of applicable law.

We will provide reasonable notice of an indemnifiable claim when practicable.

You agree to cooperate reasonably in the defense of an indemnified claim.

To the extent permitted by applicable law, disputes arising from or relating to these Terms or the Services will be brought in an appropriate state or federal court located in Nebraska, and the parties consent to the jurisdiction of those courts.

Nothing in this section deprives a consumer of rights or protections that cannot lawfully be waived under the laws applicable where the consumer resides.
